All statements, technical data, and recommendations contained herein are based upon tests we believe to be reliable. However, the accuracy or completeness thereof is not guaranteed. The proper and correct application of products and data is the responsibility of the user. The following is made in lieu of all warranties, expressed or implied:
Statguard Flooring’s only obligation shall be to replace such quantity of the product proved to be defective. Statguard Flooring shall not be liable for any injury, loss, or damage, direct or consequential, arising out of the use of or the inability to use the product. Before using, users shall determine the suitability of the product for their intended use, and users assume all risk and liability whatsoever in connection therewith.
No statement or recommendation not contained herein shall have any force or effect unless embodied in a written agreement signed by authorized officers of Desco Industries, Inc.
Statguard Flooring expressly warrants that for a period of one (1) year from the date of purchase, Statguard Flooring products will be free of defects in material (parts) and workmanship (labor). Within the warranty period, a unit will be tested, repaired or replaced at Statguard Flooring’s option, free of charge. Call our Customer Service Department at (781) 821-5609 (Canton, MA) for a Return Material Authorization (RMA) and proper shipping instructions and address. Please include a copy of your original packing slip, invoice, or other proof of date of purchase. Any unit under warranty should be shipped prepaid to the Statguard Flooring factory. Warranty replacements will take approximately two weeks.If your unit is out of warranty, call our Customer Service Department at (781) 821-5609 (Canton, MA) for a Return Material Authorization (RMA) and proper shipping instructions and address. Statguard Flooring will quote repair charges necessary to bring your unit up to factory standards.
8400 Series Static Control Vinyl Floor Tile: Statguard Flooring expressly warrants Lifetime Electrical Resistance Properties and that the 8400 Series will be free from defects in materials and workmanship for a period of 10 years after purchase provided the warranty set forth shall apply only if such products are installed and maintained in accordance with the written instructions published by Statguard Flooring and the conductivity has been tested and/or certified by Statguard Flooring. Such warranty shall be voided if such products are removed from the site of their original installation.
Without limiting the generality of the foregoing, SUCH WARRANTIES DO NOT COVER: (i) Installers' workmanship (Workmanship errors should be addressed to the contractor who installed the floor.); (ii) minor shading, color or texture between products and samples or photographs; (iii) material installed with obvious defects; (iv) installation with adhesive other than those recommended by Statguard Flooring; (v) dissatisfaction, problems or damage due to installation and/or maintenance other than as recommended by Statguard Flooring (recommended installation and maintenance instructions are available from Statguard Flooring at Buyer's request); (vi) damage due to accidents, gouges, scuffs, scratches, or indentations; (vii) damage from high heels, spike heels or inappropriate chair casters or glides; (viii) inappropriate end-users' activities; (ix) dissatisfaction, problems or damage due to irregularities caused by subfloor, including but not limited to moisture, alkali, or hydrostatic pressure in subfloor; or (x) "seconds", "substandard", "irregulars", or "off goods" which are sold by Statguard Flooring strictly on an "as is" basis.
Statguard® Conductive Acrylic Paint: Statguard Flooring expressly warrants that prior to application and for a period of 3 months from the date of purchase that our Statguard® Conductive Acrylic Paint will be free of defects in material. Statguard Flooring expressly warrants that for a period of 5 years after the date of install that our Statguard® Conductive Acrylic Paint when properly installed and maintained will meet its published electrical specs under normal foot traffic and until mechanically removed or worn away.
Statguard® Conductive Epoxy: Statguard Flooring expressly warrants that prior to application and for a period of 3 months from the date of purchase that our Statguard® Conductive Epoxy will be free of defects in material. Statguard Flooring expressly warrants that for a period of 5 years after the date of install that our Statguard® Conductive Epoxy when properly installed and maintained will meet its published electrical specs under normal foot traffic and until mechanically removed or worn away.
THE FOREGOING EXPRESS WARRANTY IS MADE IN LIEU OF ALL OTHER PRODUCT WARRANTIES, EXPRESSED AND IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WHICH ARE SPECIFICALLY DISCLAIMED. The express warranty will not apply to defects or damage due to accidents, neglect, misuse, alterations, operator error, or failure to properly maintain, clean or repair products.
Limit of Liability
In no event will Statguard Flooring or any seller be responsible or liable for any injury, loss or damage, direct or consequential, arising out of the use of or the inability to use the product. Before using, users shall determine the suitability of the product for their intended use, and users assume all risk and liability whatsoever in connection therewith.
Unless embodied in a written agreement signed by authorized officers of Desco Industries, Inc., the F.O.B. point for all products purchased from Statguard Flooring will be the F.O.B. factory.
OUT OF WARRANTY REPAIRS
Field repair or unauthorized tampering of Statguard Flooring brand products is not recommended and will nullify any and all warranties provided by DII. All Statguard Flooring items to be repaired must be returned to the location referenced by DII. Statguard Flooring will quote repair cost upon receipt and inspection of product. Repaired product will include a 90 day warranty. A Return Merchandise Authorization number (RMA#) must be obtained from Statguard Flooring for out of warranty repairs. A copy of the RMA must accompany the shipment. The RMA number must appear on the outside of returned cartons, and Statguard Flooring has the right to refuse all return shipments which do not bear the RMA number or which are shipped freight collect. Customer is responsible for all freight and transportation charges.
